Polish project hits rocky road

The project to build a section of the A4 highway in Poland between Brzesko and Wierzchoslawice in the South of the country looks set to hit major legal issues.

The project to build a section of the A4 highway in Poland between Brzesko and Wierzchoslawice in the South of the country looks set to hit major legal issues. The consortium that had been building the €159.3 million link, made up of Polish construction firm 1547 NDI and Macedonian company SB Granit, has stopped work. The consortium says that it was forced to take this action as Poland's Directorate for National Roads and Motorways (1361 GDDKiA) has withdrawn from the project. Should the dispute not reach a resolution, GDDKiA will call another tender. The consortium has said to GDDKiA that it will pay a penalty of €14.8 million for withdrawing from the work but GDDKiA may well claim that this is insufficient and request a payment of up to €30.7 million because of the six month delay with work on this section of the A4 highway.

    In Poland a legal case is now underway concerning the A4 highway project. The construction firm PBG has launched a case against Poland’s road authority, GDDKiA. The dispute centres on the stretch of the A4 linking Krzyyz and Debica Pustynia. Also involved in the case are the administrator Aprivia, and the contractor SIAC Construction. The contract to build the section of A4 was lost by the contractors in 2012 and the dispute centres on which body was at fault, with substantial claims for payment being made.
